This Privacy Policy explains how personal data is processed when you visit the Shark Companion website, contact us by e-mail, or use the Shark Companion mobile application.

4. SERVER LOG FILES

According to information provided by our hosting provider STRATO, visitors' IP addresses are stored in log files for the purpose of detecting and preventing attacks and are retained for a maximum of seven days.

When you follow an external link, you leave the Shark Companion website.

The processing of personal data on the destination website or service is governed by the privacy policy of the respective provider.

Shark Companion has no control over data processing carried out independently by third-party websites or services.

8. WEBSITE DATA RETENTION

Personal data is retained only for as long as necessary for the purpose for which it was collected.

E-mail enquiries are generally deleted when the enquiry has been fully resolved and there is no legal or legitimate reason requiring further retention.

Where statutory retention obligations apply, the relevant information will be retained for the legally required period.

Server log data is retained in accordance with the periods described above.

PART B – SHARK COMPANION APP

9. PRIVACY BY DESIGN

Shark Companion has been designed so that its essential functions are performed locally on the user's iPhone or iPad.

No user account is required to use the app.

During normal use of Shark Companion, the operator of the app does not collect personal user data and does not operate its own servers for processing user data from the app.

10. NO REGISTRATION OR USER ACCOUNT

No registration is required to use Shark Companion.

No user account is created with the operator of Shark Companion.

Names, postal addresses, telephone numbers or e-mail addresses are not requested by the app or transmitted to the operator during normal use.

11. LOCAL STORAGE OF SETTINGS AND AIRCRAFT CONFIGURATION

Users can configure various settings and information relating to their aircraft within Shark Companion.

This may include, for example:

• language and region
• aircraft model
• aircraft identification
• fuel tank configuration
• propeller information
• EFIS information
• other aircraft equipment information

These settings and data are stored locally on the user's device.

They are not transmitted to the operator of Shark Companion.

The information is used solely to adapt the app and its content to the configuration selected by the user.

12. VOICE CONTROL AND MICROPHONE ACCESS

Shark Companion provides voice functions, including voice operation of checklists and voice input for “Ask Shark” / “Frag Shark”.

For these functions, the app requires access to the device's microphone and speech recognition capabilities.

Microphone and speech recognition access is only provided after the user has granted the relevant permissions through iOS or iPadOS.

Voice recordings and recognized speech are not transmitted to servers operated by the operator of Shark Companion.

Microphone and speech recognition permissions can be changed or revoked at any time through the iOS or iPadOS settings.

The app can also be used without granting microphone access, although voice-controlled functions will then not be available.

13. SPEECH RECOGNITION

Shark Companion uses speech recognition functionality provided through iOS/iPadOS.

Shark Companion does not operate its own speech recognition server.

Where speech recognition is performed entirely on the device, the relevant speech data remains on the device.

The availability and technical processing of speech recognition may depend on the device, operating system, language and the speech recognition services provided by Apple.

Shark Companion does not intentionally transmit voice recordings to the operator's own servers.

14. SPEECH OUTPUT

Shark Companion uses speech functionality provided by the operating system for spoken output.

Texts generated or selected by Shark Companion are provided to the operating system for speech output.

Shark Companion does not operate its own external text-to-speech server for this purpose.

15. “ASK SHARK” / “FRAG SHARK”

The “Ask Shark” / “Frag Shark” function allows users to find information within the reference and information content included in Shark Companion.

Search queries and corresponding answers are processed within the app.

“Ask Shark” does not use OpenAI, ChatGPT or another external artificial intelligence service operated or integrated by the operator for processing these questions.

When voice input is used, the provisions relating to microphone access and speech recognition described above also apply.

Text input can be used independently of voice input.

16. NO ANALYTICS, TRACKING OR ADVERTISING

Shark Companion does not use analytics, behavioural tracking or advertising SDKs integrated by the operator.

The operator does not create user profiles for advertising purposes.

The app does not contain personalized advertising.

Personal user data is not sold by the operator or disclosed to third parties for advertising purposes.

17. NO LOCATION TRACKING

Shark Companion does not collect or transmit the user's location data to the operator.

The operator does not use the app to track the user's location or movements.

18. CONTACTS, PHOTOS AND PERSONAL MEDIA

Shark Companion does not access the user's address book or contacts as part of its currently provided functionality.

Photos and other personal media files are not transmitted to the operator of Shark Companion as part of the app's currently provided functionality.

19. APPLE APP STORE

Shark Companion is distributed through the Apple App Store.

When you access the App Store or download, install or update Shark Companion, Apple may process personal data independently under its own responsibility.

Such processing is governed by Apple's applicable privacy information and is separate from data processing carried out by the operator of Shark Companion.

The operator of Shark Companion does not receive the user's Apple Account login credentials through the app.

20. DISCLOSURE OF APP DATA

Because Shark Companion does not transmit personal user data to the operator during normal app use, the operator does not disclose such app usage data to third parties.

Personal data voluntarily provided directly to the operator, for example through an e-mail support request, will only be disclosed where required by law, necessary to process the enquiry, or otherwise permitted under applicable data protection law.

21. APP DATA RETENTION

App settings and aircraft configuration data are generally stored locally on the user's device.

The operator of Shark Companion has no access to this locally stored information.

The user can remove locally stored app data by changing the relevant settings or, where applicable, by deleting the app from the device.

Personal data provided directly to the operator, for example through an e-mail support request, is retained only for as long as necessary for the relevant purpose or as required by applicable statutory retention obligations.

PART C – GENERAL DATA PROTECTION INFORMATION

22. RECIPIENTS AND SERVICE PROVIDERS

Personal data is not sold to third parties.

Where necessary for operating the website, providing support or fulfilling legal obligations, personal data may be processed by service providers acting on our behalf.

In particular, STRATO GmbH provides website hosting and related technical services.

Personal data may also be disclosed where required by law or where necessary for the establishment, exercise or defence of legal claims.

23. YOUR RIGHTS UNDER THE GDPR

Where the applicable legal requirements are met, you have the right to:

• obtain information about personal data processed about you in accordance with Art. 15 GDPR

25. DATA SECURITY

Appropriate technical and organisational measures are used to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

The website uses encrypted HTTPS communication where provided by the hosting infrastructure.

Shark Companion is designed to keep essential app settings and aircraft configuration data locally on the user's device wherever possible.

26. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy may be updated if the Shark Companion website or app, their functionality, technical data processing or applicable legal requirements change.
